Formations Web Canada Inc. / Web Training Canada Inc.

TERMS AND CONDITIONS

Terms and conditions of use of courses, products, or other services (Hereafter:  Services) on Formation-enligne.ca website or any other directly or indirectly associated websites (Hereafter: the Site) operated by Formations Web Canada Inc. (Hereafter: the Seller) and all user(s) and client(s) ) (Hereinafter: the Client).

The purpose of these general terms and conditions of use is to provide a legal framework for the methods of providing the services of the Site and their use by the Client. The general conditions of use must be accepted by the Client wishing to access the Site. They constitute the contract between the Seller and the Client.  Access to the Site by the Client signifies his acceptance of these general conditions of use.  In the event of non-acceptance of the general conditions of use stipulated in this contract, the Client must renounce access to the Services offered by the Site. The Seller reserves the right to unilaterally modify the content of these general conditions of use at any time.

The Site is optimized for the Google Chrome browser and is accessible to the Clients at all times, except during maintenance periods (without notice) or in cases of force majeure beyond the Seller’s control (power or network failure, etc.). Each Client will need to have their individual email. It is not possible to share an email between two (or more) users.

The purchase of Services on the Site is considered a service “rendered” from the moment the transaction is carried out by the Client. Consequently, the Service cannot be refunded, unless there is a purchase error, at the discretion of the Seller; the Client must request a refund by email to support@formation-enligne.ca within 7 days of the date of purchase. No refunds for courses once they are started. Administrative fees of 10% of the amount to be reimbursed apply. The prices of the Services indicated on the Site are in Canadian dollars and exclude taxes. The prices of the Services are subject to change without notice. Once the purchase is completed, the Client has 12 months to use the Services. After this period, the Services may no longer be available. The Client’s data will be erased from the Site 12 months after the end of the use of the Service. The Client is therefore responsible for backing up his data/certificate.

Administration fees ($10 per change) may be invoiced to the Client when over-frequent changes (whether for e-mail modifications, deletion of an account, or any other request) require technical support from the Seller.

A fee of $10 may be charged when resetting a Client’s account following 3 exam failures associated with the Services. These fees are charged at the discretion of the Seller and the Client will be notified in advance of these fees.  Pass mark: 75%     After 3 attempts (less than 75%), the system blocks the training.

Do not purchase another course. The training will not be available until the Seller has unlocked it (it is linked to the participant’s email). The user must write an email to support@formation-enligne.ca for a technician to unlock the course. Indicate as subject “Course blocked” with its name and the email used for the course. A 50% fee on the regular price may apply for a 2nd unlock. A technician deletes the user’s course to buy the training again, with the promo code which will be sent by email. Promo code is applicable for the purchase of this training only, to the person who failed. Not transferable. This is not an instant service. The service will be performed within a reasonable time.

Although the Seller takes all necessary measures to ensure that the Services available on the Site comply with the requirements of the present regulations, the Seller cannot be held responsible for errors and omissions, changes and various interpretations between levels of government, constant modifications, or the use of the information made by the Client or its employees.  The Client is responsible for ensuring the continued competence of its employees. All Services presented by Seller are protected by copyright law. Any reproduction by the Client or agent(s), even partial, is prohibited and subject to prosecution and monetary penalties. The Services purchased by the Client are for access by one person only. Consequently, it is strictly forbidden for the Client to use them to present to more than one person or to a group of people.

The Seller may modify, suspend (for maintenance purposes) or temporarily stop the activities of the Site or any part thereof, at any time, for any reason whatsoever, without obligation to notify its customers and without incurring its liability towards the Client or any other person and cannot be held responsible for any damage, whatever its nature, resulting from the unavailability of the Service. In the event of permanent closure of the site, a notice of six (6) months will be posted on the site in order to inform the Customer.

By purchasing the Services of the Seller, the Client accepts these conditions without reservation or modifications and releases the Seller from all claims or proceedings arising from the use of the Site or the Services contained therein. In the event of a contradiction between the conditions stipulated by the Client and those of the  Seller, the Seller’s conditions will take precedence over those of the Client notwithstanding any or all conditions described by the Client in a purchase order or other communications before or after the purchase of the Service.

All Services and transactions with the Seller are governed solely by the laws of the province of Quebec.
